Effective date: October 28, 2026
These Terms of Use (“Terms”) govern your use of digipathlabs.com (the “Website”) and the testing reports, certificates of analysis and other information published or provided by DPL NV, LLC, doing business as Digipath Labs (“Digipath,” “we,” “us,” or “our”), 6450 Cameron St, Suite 113, Las Vegas, NV 89118. By using the Website, or by requesting, receiving or relying on our testing services or results, you agree to these Terms. If you do not agree, do not use the Website or our results.
Testing services for clients are also governed by any written service agreement, quote or chain-of-custody documentation between Digipath and the client. If those documents conflict with these Terms, the signed agreement controls.
1. What Digipath does, and does not, do
Digipath is an independent analytical testing laboratory licensed in Nevada. We test samples of cannabis plant material, cannabis extracts, and consumable products made with cannabis plant material and/or its extracts, for the purpose of determining and confirming compliance with Nevada requirements.
Digipath does not grow, cultivate, harvest, manufacture, process, package, label, distribute or sell cannabis or any cannabis product. We have no control over, and no responsibility for, how any product is grown, made, handled, stored, labeled, marketed or sold, or what happens to it before or after sampling.
2. How samples are collected and tested
- Samples are collected on site at the licensee’s facility by Digipath’s trained and licensed sampling agents, following the sampling procedures required by the Nevada Cannabis Compliance Board (“CCB”).
- Testing is performed using methods that comply with CCB requirements, within a quality management system operated in accordance with ISO/IEC 17025.
- Where permitted by Nevada regulations, certain analyses may be performed by another licensed and accredited laboratory. Those results are identified as such on the report.
- The client is responsible for the accuracy of the information it provides to us, including product type, batch and lot identification, and for presenting a batch for sampling that is complete and as required by regulation.
3. What our results mean
Our results report what we measure in the specific samples we collect and receive, at the time they are tested, using the stated methods. In particular:
- Results apply only to the samples tested. A sample is a small portion of a batch. Results are not a guarantee that every unit, package or portion of a batch has the same composition, and they do not describe product after it was sampled.
- All measurements have limits. Every analytical method has limits of detection and quantitation and a measurement uncertainty. “Not detected” means not detected above the method’s reporting limit, not that a substance is absent.
- A pass or fail result is a regulatory determination, made against the action limits in effect when testing was performed. It is not a statement that a product is safe, effective, or suitable for any particular person or use.
- Not medical advice. Nothing on the Website or in our reports is medical, health or legal advice. Information on this Website about cannabis and its effects is general and educational only.
If we identify an error in a reported result, we will correct it and, where required, notify the client and the CCB and issue an amended report, as provided by Nevada regulations and our quality system.
4. Reliance on results; disclaimers
Our reports are prepared for the client that engaged us and for the regulatory purposes described above. Anyone else who reads or relies on a Digipath result, including retailers, consumers and other third parties, does so at their own risk and is not a party to our engagement.
EXCEPT AS EXPRESSLY STATED IN A SIGNED SERVICE AGREEMENT, THE WEBSITE, ITS CONTENT AND OUR RESULTS ARE PROVIDED “AS IS,” AND DIGIPATH MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT, AND NO WARRANTY REGARDING ANY PRODUCT THAT WAS TESTED.
5. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGIPATH, ITS OWNERS, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST PRODUCT, RECALLS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE WEBSITE, OUR SERVICES, OR ANY PERSON’S RELIANCE ON OUR RESULTS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGIPATH’S TOTAL LIABILITY FOR ANY CLAIM RELATED TO A TEST OR REPORT IS LIMITED TO THE FEES ACTUALLY PAID TO DIGIPATH FOR THAT TEST. DIGIPATH HAS NO LIABILITY TO THIRD PARTIES WHO RELY ON A RESULT PROVIDED TO A CLIENT.
Nothing in these Terms limits liability that cannot be limited under applicable law, or any obligation we have under Nevada cannabis laws and regulations.
6. Certificates of analysis
Only certificates of analysis issued by Digipath, or verifiable through our client portal or the State of Nevada tracking system, are valid. Altering, excerpting in a misleading way, or misrepresenting a Digipath result, or presenting a result as applying to a different batch or product, is prohibited, and Digipath is not responsible for any altered or misattributed report.
7. Client portal and ordering
Orders and results are handled through our client portal, which is provided by Confident LIMS. Use of the portal is also subject to its own terms. You are responsible for keeping your portal login credentials secure and for all activity under your account.

10. Governing law and venue

Any dispute arising out of these Terms, the Website or our services will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to their jurisdiction.

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. We may update these Terms from time to time; the effective date above shows the latest revision, and changes apply from the date they are posted.
