This Privacy Policy explains how DPL NV, LLC, doing business as Digipath Labs (“Digipath,” “we,” “us,” or “our”), an independent cannabis testing laboratory located at 6450 Cameron St, Suite 113, Las Vegas, NV 89118, collects, uses and shares information through this website, digipathlabs.com (the “Website”), and in the course of providing our laboratory testing services. By using the Website or contacting us, you agree to the practices described here.
1. Who we are
Digipath is an analytical testing laboratory licensed in Nevada. We test samples of cannabis plant material, cannabis extracts, and consumable products made with cannabis plant material and/or its extracts for regulatory compliance. We do not grow, cultivate, manufacture, process, distribute or sell cannabis or any cannabis product.
2. Information we collect
Information you give us. When you use the contact form, sign up for updates, call or email us, we collect what you choose to provide, such as your name, email address, phone number, company or license name, and the content of your message.
Client and testing information. When a licensed business engages us for testing, we collect business and contact details, license numbers, sample and batch identifiers, chain-of-custody records, and the test results we generate. Much of this is collected through our client portal (see Section 5) or by our sampling agents at your facility.
Information collected automatically. Like most websites, our hosting and security provider automatically receives technical information when you visit, such as your IP address, browser and device type, the pages you request, and the date and time of your visit. This is used to deliver the Website, keep it secure and prevent abuse. The Website does not use advertising cookies, analytics tracking or social-media tracking pixels.
3. How we use information
- To respond to your questions and requests and to provide quotes;
- To schedule sample collection, perform testing, and deliver results and certificates of analysis;
- To meet our legal and regulatory obligations, including those of the Nevada Cannabis Compliance Board (“CCB”);
- To maintain our quality management system, including records required to operate in accordance with ISO/IEC 17025;
- To send service updates you have asked for; and
- To operate, secure and improve the Website.
4. How we share information
We do not sell personal information, and we do not share it with third parties for their own marketing. We share information only as follows:
- Regulators. As a licensed laboratory, we are required to report test results and related sample information to the CCB and to the State of Nevada’s cannabis tracking system, and to provide records to regulators on request.
- Service providers that help us run our business and this Website, under obligations to protect the information, including our website host (Cloudflare), our form-delivery service (Formspree), our email provider, and our laboratory information management system and client portal (Confident LIMS).
- Other licensed laboratories, where an analysis is performed by another licensed and accredited laboratory as permitted by Nevada regulations, limited to what is needed to perform that analysis.
- Legal reasons, when required by law, subpoena or court order, or to protect our rights, our clients, or the public.
- Business transfers, in connection with a merger, acquisition or sale of all or part of our business, subject to this Policy.
5. Client portal and third-party links
Orders, sample information and results are handled through our client portal, which is operated by Confident LIMS under its own terms and privacy policy. This Website also links to other sites, such as social media pages. We are not responsible for the privacy practices of sites we do not operate, and we encourage you to read their policies.
6. Cookies and fonts
The Website does not set cookies of its own. Our hosting provider may use strictly necessary security cookies to protect the Website from malicious traffic. The Website loads fonts from Google Fonts, which means your browser sends a request to Google that includes your IP address; see Google’s privacy policy for details.
7. Data security and retention
We use reasonable administrative, technical and physical safeguards to protect the information we hold. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. We keep testing records, chain-of-custody records and results for as long as required by Nevada regulations and our ISO/IEC 17025 quality system, and other information only for as long as needed for the purposes described above.
8. Your choices and rights
- You can ask to review, correct or update personal information you have given us by contacting us at the address below.
- You can ask us to stop sending you updates at any time.
